Obama and Congress Request and Obtain Extension of Time to File Opposition Brief to Kerchner Appeal
On January 19, 2010, I [Att. Mario Apuzzo] filed the Appellants' Opening Brief in the appeal of Kerchner et al. v. Obama et al. which is currently pending in the Third Circuit Court of Appeals in Philadelphia. In that appeal, we maintain that the New Jersey Federal District Court erred in dismissing our case by ruling that plaintiffs do not have standing to challenge Obama's alleged eligibility to be President and Commander in Chief of the Military and that our case presents a non-justiciable political question. In our case, we have provided the Founder’s and Framers’ definition of an Article II “natural born Citizen” which is a child born in the country to citizen parents. We maintain that Obama is not an Article II “natural born Citizen” because he lacks unity of citizenship and allegiance from birth which is obtained when a child is born in the United States to a mother and father who are both United States citizens at the time of birth. Obama’s father was only a temporary visitor to the United States when Obama was born and never even became a resident let alone a citizen. I'd certainly urge everyone to read the Kerchner et al Initial Appeals Brief which is on Attorney Apuzzo's website. It gives one a wonder grounding in not only the original action as well as the rulings by the original judge (Simandle) who tried to dispose of the case - at the urging of DOJ attorneys ... the attorneys for We The People.
ReplyDeleteBut even more than that, it puts the lie to all of the positions held and proffered by the Obama Flying Monkeys as to why we should have an unconstitutionally-qualified man in the oval office.
Don't worry about any legaleese or specific citations; you can certainly understand the down-to-earth arguments of Mario Apuzzo on behalf of his Plaintiffs.
Yes, I read the brief the other day. It is a pretty strong argument---even stronger than Donofrio's.
ReplyDeleteIf it goes down in flames, it won't be because of the merits of the case, it will be because of a biased "Progressive" justice system that refuses to cop to the fact that the intent of the Natural-Born clause was an attempt by Our Founders to protect against Presidents with split allegiances.
To me, the whole question of if he needed both parents to be of U.S. citizenship or not, in order to be considered Natural-Born, is kind of a mute point when you consider the following:
Obama's father worked for the Kenyan government. Considering that children born on U.S. soil, who are born to foreign diplomats, are not even allowed to automatically become even mere citizens of the United States is pretty damning to Obama, in my opinion...
Obama said he was, "a citizen of the world." I believe him...
Obama was not serving on behalf of the United States in any official capacity when he decided to travel to Kenya and help campaign for Odinga. Odinga, of course, is now the Prime Minister of Kenya. Showing such an allegiance to the affairs of the government of your father demonstrates to even the most blind that he DOES indeed have allegiances to the government of the other half of his dual citizenship. In Our Founding Fathers' minds, and any sane persons mind, that would have immediately disqualified him!
Where do most of his immediate blood relatives live (as in brothers, sisters, aunts, and uncles)?
In Indonesia and Kenya, of course (well, unless most of them have already snuck into the U.S., like one of his aunties did).
So, my question to all the "Progressive" judges and lawyers out there is quite simple: "Honestly, should Indonesia or Kenya become unstable and launch a nuclear missile at the United States, are you so deluded as to think that Obama will somehow be able to push that metaphoric red button in retaliation and risk killing his own brothers and sisters because of the actions of their governments ?"
If you fatuously answered "yes" to that question, then congratulations, you have no soul and can readily slit all of your own siblings' throats without hesitation. Or, at the very least, you are implying that Obama is an emotionless psychotic. Well... Maybe that is true, but I'm not willing to bet my family's life on it.
