28th Amendment: Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators or Representatives

Rep. Virginia Foxx (R-NC 5th District) suggested this idea, for a 28th amendment to the Constitution, in a letter to President Obama, Sen. Richard Burr, and Sen. Kay Hagan on November 10, 2009.

Sounds like a fabulous idea, so I say, keep the message viral until we elect a more balanced Congress in 2010.  This proposal will never be addressed by this Congress so long as Democrats control all three bodies of our government.

The Constitution provides that an amendment may be proposed either by the Congress with a two-thirds majority vote in both the House of Representatives and the Senate or by a constitutional convention called for by two-thirds of the State legislatures. None of the 27 amendments to the Constitution have been proposed by constitutional convention. 
Caution:  Other 28th Amendment proposals are floating around on the internet, so do not sign a petition unless you have read it thoroughly.  Some call for direct democracy, which is what every socialist/marxist/communist wants. Again, caution!

  1. What has not been mentioned here is the fact that such an amendment can be proposed by two different methods under Article V of the Constitution. The second method is by an Article V Convention. The Congressional Record shows that all 50 states have submitted 750 applications for a convention call. Congress must call if 34 states submit 34 applications. Thus Congress is obligated to call a convention. The texts of applications can be read at www.foavc.org.

  2. I love this proposal. It would help to check the elitist tendencies of our government.
    But some could argue that making them less comfortable would lead to more corruption.
    A way to curb the influence of big government and make us a more democratic nation would be to have more direct democracy. How can anyone possibly argue they want to limit big government yet say that giving people more individual power is contrary to that desire?

  4. I suggest an expanded version such as:

    Article I. Congress shall make no law that applies to the citizens of the United States that does not apply equally to Senators, Representatives and all federal employees, except the military. Congress shall make no law that applies to Senators, Representatives and all federal employees, except the military, that does not apply equally to the citizens of the United States.
    Article II. Agencies of the executive branch shall create no regulation that applies to the citizens of the United States that does not apply equally to Senators, Representatives and all federal employees, except the military. Agencies of the executive branch shall create no regulation that applies to Senators, Representatives and all federal employees, except the military, that does not apply equally to the citizens of the United States.
    Article III. Congress and agencies of the executive branch shall correct all affected laws and regulations within one (1) year of the ratification of this Amendment. All affected laws and regulations that have not been corrected after one (1) year are void.

  5. If we are a government by the people, then why can't we decide this one on the ballot. Afterall we pay those crooks in Washington, why should they get better benefits than those who pay them.

    Why do people put so much faith in snopes.com Since when am I required to accept the opinion of an ideologically driven couple working from their home. They are making a fortune off Americans who need somebody to tell them what to believe? That is a lazy and risky way out of doing the research and thinking logically for yourself. They are just human beings with their own bias (well intentioned as it may be) making the evidence fit their beliefs.
